Sued Over Soda – Passenger Wants $500K from Virgin

The passenger was informed, repeatedly, that the flight attendant call button was not the proper way to request a soda.

Burlingame-based Virgin America Airlines really wants you to use the touch screen system to order your drinks.

SF Gate reports that a passenger on a Virgin flight from Philadelphia to SFO in April 2012 got into a dispute with flight attendants when he insisted upon ordering a soda verbally rather than using Virgin's touch screen ordering system. After his third request, he finally got his soda.

He also got an unpleasant surprise upon his arrival at SFO—he was questioned by the police and the FBI. The passenger, Salvatore Bevivino, 52, of Brisbane, says the pilot falsely accused him of swearing at the flight attendants.

FBI agents decided that ordering a soda verbally did not rise to the level of interfering with a flight crew and declined to arrest him. According to the police report, he was also accused of not flushing the toilet.

The unhappy Bevivino is suing Virgin for $500,000. So far, Virgin has no comment on the lawsuit.
